Terms of Service

These Terms of Service ("Terms") govern your access to and use of hyliax.net, admin.hyliax.net, and related services operated by Hyliax (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

Tenants on the Hyliax platform are additionally bound by a separate tenant agreement entered into directly with the operator that governs hosting, support, billing, and content responsibilities. In the event of a conflict between these Terms and a tenant agreement, the tenant agreement controls.

1. Eligibility

You must comply with all applicable laws in your jurisdiction when using the Services. You must be at least the age required to use general-audience websites in your jurisdiction.

Administrative access to admin.hyliax.net is granted only to authorized tenant administrators. You may not access or attempt to access administrative features without authorization.

2. Permitted Use

• You may use the Services for their intended purpose, including evaluating the Hyliax platform and, if you are an authorized tenant administrator, managing your tenant configuration.
• You may not use the Services for unlawful, abusive, or harmful activities.
• You may not attempt to disrupt, overload, reverse engineer, or exploit the Services or their infrastructure.
• You may not scrape, crawl, or systematically extract content from the Services without explicit permission.
• You may not share authentication credentials or attempt to access another tenant's data or configuration.

3. Tenant Sites and Third-Party Content

Hyliax hosts websites and services for independent game developers ("tenants"). Tenant sites are operated by the respective tenants and may have their own terms of service, privacy policies, content, and rules.

Content available on tenant sites is the responsibility of the respective tenant. Hyliax does not endorse, verify, or assume responsibility for tenant content.

References to specific tenants on this Site are illustrative and do not constitute endorsements of any particular content or tenant.

4. Data Ownership

Tenants retain ownership of game files, branding, content, and analytics data associated with their tenancy. Hyliax retains ownership of the platform software, infrastructure, and operational data necessary to run the Services.

Tenants may export their data at any time upon request, subject to the terms of their tenant agreement.

5. Intellectual Property

The Services, including their design, branding, copy, and software, are the intellectual property of Hyliax and its operator.

Ren'Py is a trademark of its respective owners. Hyliax operates independently and is not affiliated with, endorsed by, or sponsored by the creators of Ren'Py.

Patreon, SubscribeStar, Discord, Cloudflare, and other third-party services referenced in the Services are trademarks of their respective owners. Hyliax operates independently and is not affiliated with these services.

6. Third-Party Services

The Services integrate with and link to third-party platforms including Discord, Patreon, SubscribeStar, and Cloudflare. We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is subject to their own terms.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

We do not guarantee uninterrupted availability, error-free operation, or the accuracy or completeness of any information in the Services. Descriptions of platform features in marketing materials are for informational purposes and do not constitute a binding offer.

8. Limitation of Liability

To the fullest extent permitted by law, Hyliax and its operator shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.

9. Indemnification

You agree to indemnify and hold harmless Hyliax and its operator from any claims, damages, liabilities, or expenses arising from your use of the Services or your violation of these Terms.

10. Termination

We reserve the right to suspend or terminate access to the Services at any time for violations of these Terms or misuse of the Services.

Termination of tenant accounts is additionally governed by the tenant agreement.

We reserve the right to modify, suspend, or discontinue the Services at any time, with reasonable notice to affected tenants where practical.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

12. Changes to These Terms

We may update these Terms periodically. Continued use of the Services after changes indicates acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict of law principles.
